Xiamen courts strengthen judicial marine ecosystem protection

The Xiamen Intermediate People's Court and the Tong'an District People's Court held a news briefing on May 22 for the International Day for Biological Diversity, reporting on their recent work. 

At the briefing, 10 measures were announced to support the judicial protection of the marine ecosystem. These focus on marine biodiversity and real-world court practices, outlining clear steps and priorities for Xiamen's courts in handling marine environmental criminal cases, including trial procedures, ecological restoration, expert support, cross-agency cooperation, and public legal education.

Since the 14th Five-Year Plan (2021–2025), Xiamen's courts have focused on specialized adjudication, coordinated governance, and public education on the rule of law to build a comprehensive, multi-layered judicial protection system for the marine ecosystem. They strictly enforce the law in marine environmental criminal cases, having concluded 63 cases and sentenced 107 defendants.

The courts have also developed innovative restoration methods that combine direct and alternative approaches, with supervisors overseeing restoration and conducting post-ruling follow-ups, in line with the public participation principle in environmental law. These include a "Cloud Coral Garden" smart restoration project, marine carbon credit purchases, coral planting, and the country's first public-interest carbon account for ecological justice. 

The courts have also expanded biodiversity protection by issuing special orders for rare marine species and building a system to protect both species and their habitats, with Xiamen Intermediate Court having established a collaborative approach to protecting local rare and endangered wildlife, working closely with the management agency of the Chinese white dolphin and amphioxus nature reserve. This practice was included in the report Judicial Protection of Biodiversity in China.
